Terms and Conditions

Preamble

1. These general conditions of sale are agreed between Mário José Baltazar de Carvalho, headquartered at Rua da Quinta do Velho, lot 23 r/c left, 7645-305 Vila Nova de Milfontes, Tax Identification Number: 212404130 and contact +351 962282863, hereinafter referred to as "Águas Vivas" and people wishing to make purchases through the websitewww.aguasvivasapnea.com, hereinafter referred to as "User".

2. The parties agree that purchases made through the website www.aguasvivasapnea.com will be exclusively governed by this contract to the exclusion of any conditions previously available on the website.

ARTICLE NO. 1 - PURPOSE

1 - The purpose of these general sales conditions is to provide and define all necessary information to the User about the ordering, sale, payment and delivery of purchases made on the website _cc781905-5cde-3194- bb3b-136bad5cf58d_www.aguasvivasapnea.com.

2 - These conditions regulate all the steps necessary to place an order and guarantee its follow-up between the Contracting Parties.

ARTICLE 2 - ORDER

The User places his order by completing the purchase process presented on the website.www.aguasvivasapnea.com, adding the product(s) or service(s) you want to order to the shopping cart.

2 - To send your order, the User must:

b) Log in (providing a combination of email and password chosen by the User when registering).

c) Complete the information and choose the options available to you during the order completion process (delivery and billing address, shipping method, payment method, as well as the NIF and the name that, for tax purposes, want them to appear on the invoice).

3 - The final confirmation of the order by the User is equivalent to full and complete acceptance of the prices and description of the products available for sale as well as these General Sales Conditions, which will be the only ones applicable to the contract thus concluded.

4 - Águas Vivas (Mário Carvalho) will honor orders received online only up to the limit of available stocks. In the absence of availability of the product, Águas Vivas undertakes to inform the User as soon as possible.

5 - The data contained in the invoice are the sole responsibility of the User.

Once issued, the invoice cannot be reissued with changes.

6 - Order requests are valid for 7 days, unless the order is registered under a promotional campaign that defines a different period, and it is not possible to guarantee prices, discounts, promotions and offers beyond this period.

If payment is not received by our services within the aforementioned period, the order will not be validated. Any amount received after this date will be returned or used in a new order.

ARTICLE 3 - PAYMENT

1 - On the websitewww.aguasvivasapnea.com, the User is offered the following payment methods:

a) Credit or debit card (Visa, Mastercard) – Through Wix Payments;

b) Transfer via PayPal;

c) Cash on delivery (Only for Mainland Portugal, the Azores Archipelago and Madeira); not authorized for promotions.

d) Cash payment – Available for in-person withdrawals at Headquarters.

2 - In the case of payment by credit card, the debit will be made on the User's card immediately after confirmation of the order. If some products ordered are sold out, their value will be credited to the User's card after the order is closed.

ARTICLE 4 - DELIVERY

1 - Orders are shipped within 30 working days after ordering. Delivery is carried out via CTT or by Carrier, depending on the weight, volume and destination of the order.

2 - Shipping costs are added to the ordered products, which vary according to their weight and dimensions and the packaging that will contain them.

ARTICLE 5 - PRICES

1 - Prices must be understood in “Euros” €, with fees and taxes included, taking into account the VAT in force on the date of payment of the order.

2 - If there is an increase in the price of any product, the User will be informed immediately, and may choose to receive his order (paying the difference) or cancel it.

ARTICLE 6 - CANCELLATION AND RETURN

1 - The cancellation or return process is handled on a case-by-case basis by Águas Vivas (Mário Carvalho).

The request must arrive in writing to the contact emailaguasvivas.apnea@gmail.com, within 2 days after ordering, with the instructions for canceling or returning the goods answered and defined by Águas Vivas (Mário Carvalho), through the same means of communication.

2 - Whenever possible, the return must be made through the same payment method, but if this is not possible, the user must present proof of payment and account or card ownership, so that make the return by Bank Transfer.

3 - Águas Vivas (Mário Carvalho) undertakes to reimburse the User within a maximum period of 30 days.

4 - The returned products must be in a salable condition, that is, in the same condition in which they arrived in the User's hands, without any anomaly or damage.

5 - If the value resulting from the exchange of products of an order is lower or higher than the initial value of the same, the conditions of adjustment will be indicated by Águas Vivas (Mário Carvalho).

ARTICLE 7 - PRIVACY POLICY

The processing of your data is carried out in compliance with the legislation on the protection of personal data. The same, subject to computer processing, will appear in the database(s) of Águas Vivas and are intended for the registration and presentation of other products and/or services, as well as institutional information, to be made available by them.
